These standard terms and conditions apply to all photography or video commissions (whether paid or on a content-share/TFP basis), unless specific rights assignment or release forms have been signed by both parties in respect of each shoot.
As per UK copyright law, the images are copyright of TS Photography and may not be used commercially or reproduced in any format (including websites) without the express written permission of TS Photography. Such permission may be subject to a usage fee/contract. Unauthorised use of images are chargeable at our standard rate of £1,250 per image per use (for clarification each separate web page an image appears on is classed as a separate use even if the pages are within the same website).
Invoice payment is due within 28 days of invoice date, after this time 10% will be added weekly until payment is made. No rights are transferred until all outstanding invoices are paid in full. Deposits of 25% on booking a shoot are welcome but are not always necessary for existing clients.
Submitting the images to AI services for further editing or distribution is prohibited unless specific permission in writing is granted.
All reasonable efforts will be made to deliver a selection of edited images in high quality within 72 hours of the shoot date, but during busy times this may increase up to 10 working days. The remaining images will be delivered within 15 working days unless informed otherwise by the photographer.
For content share/TFP shoots, credit must be given in written publications or electronically; photos should be credited to “Tim Shorey Photography”. Where this is a paid service it is not mandatory to give credit, but it is of course more than welcome where it is given.
The photographer retains the permanent right to be recognised as the originator of the images.
The photographer will not use the images for any commercial purpose portfolio, without prior arrangement, for a minimum period of five years after the invoice date (does not pply to use of the images in portfolios promoting TS Photography). Following this period the photographer will be entitled to use the images in any showcase or retrospective of the photographers work, subject to any exclusions or retouching/cropping agreed in writing within ten days of the original shoot.
The photographer may use a small number of images, usually less than 5% of images provided, in their own personal portfolio, third-party portfolio websites, or on social media. If any images are deemed sensitive or unsuitable for this use they should be identified to the photographer, by the client, in writing within five days of the shoot. The photographer accepts no liability for images that enter the public domain where no written exclusion was provided by the client. Any and all liability, where relevant, does not exceed the value of the invoice for the original shoot.
The photographer reserves the right to permanently delete any images that are not deemed, in their sole discretion, to be of acceptable professional quality (including for example—exposure, composition, lighting, facial expression, and so on). The client has no right to a copy of these rejected images.
The client may request a copy of the retouched images at any time for one year following the date of invoice, after this date best endeavours to accommodate further requests in a reasonable timescale will be considered but cannot be guaranteed (note that TS Photography does not archive all images as standard beyone one year).
None of these terms affect any right by the client or the photographer in UK law.
